And so it begins - Fast food drive through feeding frenzy for PPC's as well

When the fast food drive through's started re-opening for some strange reason some people flocked to these places resulting in huge queues just for some greasy fried chicken, sitting in a drive through queue for food knows how long, then possibly followed up by munching the stuff in a car park has had the knock on effect of being a gift to the PPCs
[quote]
Hungry KFC customers queuing up at a drive-thru were shocked to be hit with £100 parking fines for waiting too long in the car park. The parking charge notices were issued to people who waited longer than the 75 minutes permitted at the KFC drive-thru in Rock Ferry, the Wirral. This was despite long queues which left people with waiting times of up to two hours or more. Even though none of the customers were in parking bays, they were automatically hit with fines because their car registration was caught on CCTV when they entered the KFC site and when they left, which showed they had stayed over the maximum time allowed. The first people knew about it was when a letter landed on their doormat from private car park operators Civil Enforcement a few days later, ordering them to pay a £100 parking charge – reduced to £60 if paid within 14 days.

Could have predicted this would happen.  KFC need a barrage of complaints.  They should have ordered their dogs to switch the camera off during lockdown relaxation months, but did they?  No.  Will they do this and cancel PCNs?  Yes, I am sure they can, if pressure is applied.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As waiting in a queue in a drive though is not parking, DVLA details will have been obtained without due cause.  The PPC are going to regret issuing these ticket and KC will have to spend a lot of money dealing with this.

I suspect the tickets were given not for parking , but for being on the land in excess of permitted.time
ANPR cameras do not watch you parking up and exiting your car , they record details of entry to land time and time land exited , this is the reason we have grace periods

Perhaps, but the permitted time is for parking.  The purpose of the car being there was NOT for parking.  DVLA details therefore  wrongly obtained.  imo.

There have been a few cases where it was judged that waiting is not parking, so by its very nature a Parking charge notice was incorrectly issued.
A few GDPR claims against landowners ( such as KFC franchisees) may sharpen minds a little

Yeah, but who's going to do that?  Needs more grit and resilience than that displayed by most of the snowflakes who come here who struggle to put anything together unless there's a template, then have to copy and paste it back and ask if it's the correct one.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

99.9 of all airport cases are stopping , not parking , the BPA and IPC allow members to access the DVLA  for those sites , the DVLA clearly know the locations and reasons ,
but before we get carried away , v888/3 for use by companies that issur parking charges , asks REASON for wanting info , as v888/3 is used for reasons other than parking

the (sad) link shows signage that does not actually state parking , it states "time on land "

and in the (sad) link KFC staff member (kevin) said we will get those fines quoshed , or poshly "Our longer than usual queues did result in a few unfair fines for the car park but we’ve put that right now by cancelling the charges.’" right , kevin
