Even if it German law applies, it's still coveredsoxiez said:
I've been in touch with Citizen's Advice and they've now told me this is not the case. It is apparently the laws of where the company I purchased from are based, not the consumer's. Which according to the t&cs in my booking, is Germany. I'm currently trying to find out if there's a German equivalent to this law, but thought I would let you know. I really hope they have something similar.Life__Goes__On said:Yes, it's English law, they agree to it as as a condition of selling a package holiday to a person who is in the UK
https://www.abta.com/tips-and-advice/is-my-holiday-protected/new-package-travel-regulations
These regulations apply to travel arrangements booked on or after 1 July 2018, and sold or offered for sale in the UK.
https://www.abta.com/tips-and-advice/is-my-holiday-protected/new-package-travel-regulationsPackage holidays offer the greatest level of protection.
Whether you book your package holiday or linked travel arrangement via a website, in person or on the telephone, they should all provide the same information and the same protection for a package holiday and linked travel arrangement. The regulations apply to sales in the EU so if the package or linked travel arrangement is sold to you outside the EU you will not be entitled to the same protection.
EDIT They are based in Vienna Austria

Thanks for the clarification - does this apply if they are not ABTA members? If you google 'tourradar abta', it appears that they are, but they don't show up under ABTA's membership list at all, and I did not recieve a certificate when booking, which is needed to put a complaint in against them to ABTA.Life__Goes__On said:

Their terms state that German law applies to this booking for some reason (I think this is due to the actual tour operator being based in Germany), so I was going off that. As a side note, digging through the German law aspect of it, I found they do have a similar law for this kind of thing, but that it has been overidden by a special Covid-19 clause which unfortunately invalidates it. So hopefully the ABTA thing is enough.
In any case, 24 hours has now passed and I've not responded to the tour company. I've sent their message to Paypal and will await their decision. I guess then if it doesn't go the way I want it to, I can look further into it again.0 -
When did you book the trip? Was there a reason you used Paypal and not a card?

I booked it on the 29th of January 2020. I used Paypal because at that time I did not have a credit card.Life__Goes__On said:When did you book the trip? Was there a reason you used Paypal and not a card?0 -

Unfortunately I lost my Paypal cases. They cited the reason being that I apparently "did" receive the service that I paid for. I've been given some contact details for executive escalations so am writing a letter to them now compiling all my evidence. Will report back where that gets me.Life__Goes__On said:soxiez said:

What proof did Paypal provide in saying you were provided with the service?soxiez said:

If they still refuse to pay out after going further up the chain report them to the Ombudsman.

They didn't provide any proof, I will request it in my appeal letter though. Thank you, that is certainly next on the hit list if this appeal doesn't get me anywhereLife__Goes__On said:
