Furlough

I was laid off due to COVID 19 but before the government announced any financial support. My ex employer is refusing to put me on furlough pay because apparently they are claiming they need the money in advance but they cannot afford it. What are my rights ?

    Being furloughed is entirely at an employer's discretion, as is the decision to rehire you to furlough you. Provided that your employer met its statutory and contractual obligations (redundancy etc) when you were laid off, you have no further rights.
  • The government portal employers use to claim the much advertised 80% or £2500  is not yet available. This means anyone who needs to be paid "now" would be paid by the employer and claimed back at a later date. Some companies will be facing very real cashflow problems.
