    BW Legal have said in their email that they will be at liberty to enter a county court judgement against me if I don't contact them to arrange payment. Obviously I don't want a CCJ hanging over me but can they do that before it's been to court?
    That's what will happen if you don't file your Defence on time.

    Thanks. They give the impression they will do it if I fail to ring them now and set up a payment. I absolutely don't intend on failing to defend

    Hi. Yes, it was an email that I have pasted below. It was the part I've highlighted in bold I was questioning.

     "I write in reference to your email dated 27 October 2020.

     I can confirm I have referred this to our client to obtain the evidence requested. Once received, we will revert back to you. 

     In the meantime, a claim has been issued against you on 26 October 2020 and deemed served on 02 November 2020. If no contact is received in regards to the outstanding balance of £240.34, we will be at liberty to enter a County Court Judgment (CCJ) against you, in order to avoid this you can call us on 0113 323 1784 within 14 days from the date of this email to set up an affordable payment arrangement which is suitable for you

     Alternatively, you can use our website www.bwlegal.co.uk to set up the arrangement. Our customer portal provides you with the functionality to speak to us by webchat, complete your income and expenditure or make a payment. 

     If you do not wish to set up a payment arrangement in regards to the above balance, please respond to the claim form accordingly which will be deemed served on 02 November 2020.

    Seems factual to me , certainly not misleading in anyway , it is the facts as known to them

    The bottom paragraph is the disclaimer , where you follow the claim defence path if not responding

    You would think some of the sentence is missing , as in no contact made by the time they can file for judgment against the defendant, or some words to that effect , but if that happened it's how a default CCJ happens anyway

    Yes, definitely a misleading statement that needs to be brought to the attention of the SRA.
    Thanks everyone. Yeah, I read that to mean if I don't contact BWL in regards to the balance they will enter a CCJ against me. Sorry if it sounds stupid, who are the SRA and how do I bring it to their attention? Is it worth me mentioning this in my statement?
