Only first letter of number plate entered - Quick response would be appreciated PCN Appeal
Hi Guys I was hoping someone could help me with a bit of advice. I used a car park on private land at the end of January and it was one of the ones where you have to put your number plate into the machine before you pay for your ticket. I put the first letter of my number plate in but then it wouldn't take any more so I paid and put the ticket in my car. I paid for two hours and was in the car park for just under two hours. The ticket only had M printed on it, which is the first letter of my number plate, but if also had the time I bought the ticket, time it expired and 312185 on the bottom of the ticket, which I assume if the reference number for the parking machine. A couple of days ago I got a a fine through the post from Premier Parking Solutions, saying they had photos of me on an ANPR camera entering and leaving the car park but had no trance of my payment so said there was a £100 fine, reduced to £60 if I paid before 14 days. I had kept the ticket so appealed the fine and sent a copy of ticket explaining that the machine wouldn't take my number plate and just asked for payment. I got a reply saying my appeal had failed because there was no trance of anyone else having a problem with the machine and my ticket wasn't valid because the number plate wasn't printed on the ticket. It shows I paid and didn't stay any longer than I paid for but they said I breached the terms and conditions.Â* The appeal process with Premier Parking Solutions is finished now so is it worth me appealing with IAS or just sucking it up and paying the £60? If I do, I need to pay it by 13/03/20. Many thanks in advance for any advice you can give me Steve | |

It is not a fine.
Appealing to the IAS kangaroo court is not advised.
Have you read the sticky thread for NEWBIES yet that asks you to read it before posting? It explains all your questions and tells you not to identify the driver.
What happened when you complained to the landowner?
Have you complained yet to your MP about this unregulated scam?
I have given your question about paying a stiff ignoring.
Other than that, you are now in ignore mode unless you get real court papers.

Thanks for your response. I have started with the NEWBIES thread so apologies for asking before I'd finished it, I'm a bit stressed over the situation, again apologies,
Unfortunately i have already identified myself as the driver in the appeal0 -

Wondering what if anything the IPC say, which might be useful for a rare IAS foray...
Certainly no paying this; such cases are won by Defendants in court:

This is not likely to be a keying error. If you were unable to enter your VRN then you were unable to fulfil your part of the contract. It was frustrated, read this
https://en.wikipedia.org/wiki/Frustration_in_English_law
If there is no contract there can be no breach ad contract, and the scammer has no cause of action.Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

Hi folks.
So I'm back as I have received a letter from BW Legal saying they have been instructed by Premier Parking Solutions to commence legal action in the form of issuing a claim against me in respect of the debt.
The Contravention Description on the letter is given as "no trace of payment", however there is a way to trace the payment as I have the ticket and it has the first letter of my number plate on it. I was thinking of responding to them and requesting a copy of all the transactions that went through the machine at the time I parked and paid, and then they would be able to trace my payment.
Do you think that is my best course of action or do you suggest something else?
Ideally I'd like to avoid any court proceedings as this may have a negative impact on my work.
Many thanks in advance

Send Premier Parking Solutions a SAR and specifically request all details relating to the serial number on your ticket; because, that is now your personal data as the parking company can identify you from that serial number.2

Brilliant, thanks. I was gonna ask in the letter to BW Legal how I submit a SAR to get the information. I'll send one to Premier Parking Solutions as well. Thanks for the response, it's really appreciated.Castle said:Send Premier Parking Solutions a SAR and specifically request all details relating to the serial number on your ticket; because, that is now your personal data as the parking company can identify you from that serial number.0 -
There's a link to a SAR template to use in the NEWBIES FAQ sticky, second post. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Court proceedings in most cases have zero bearing on work and are so common they we ont even register. If you lose, you pay promptly and no flags ever appear on the system.
Clearly if you're military and on standby to be hoiked out the country or 'a specialist government employee' that may be a bit different, but the exception not the rule.
Since you can prove payment and they have video of the vehicle and you are in possession of a ticket which you paid for (so clearly didn't transfer it to someone else) there is zero loss or benefit in them pursuing it. The claim is an abuse in my view. Similar cases have been defended.2
