Buyer delaying exchange - Homebuyers Survey late in the day!

Hi all,

I'm hoping for some advice on what we can do in our current situation. Sorry in advance for the long winded post! Just didn't want to miss anything.

We're in a chain with three other people with us being the 2nd in the chain. The buyer of our house is buying the property as an investment and therefore has no deadline on when she needs to exchange/complete unlike the rest of us. We accepted the offer on our house on the 16/09 and we all agreed that we would aim to be completed within 12 weeks.

I'm currently four months pregnant and would like to be in our new family home for Christmas. Our vendor are a young family and there's is an elderly lady who was widowed this year moving into a retirement flat who all also wants to move before Christmas. All three of us have to arrange removal firms and have agreed that we would exchange 6th December with completion being 13th December. The rest of the chain don't want to complete later than this.

Our buyer agreed with this timeline, but decided late in the day i.e. end of November, that she was going to get a home-buyers survey - I explained to her that the turnaround on this would be 7-10 days given that it needs to be booked and then the report created. I did say to her I was surprised this had not been done sooner or that her Solicitor had not advised of the timescales. She reassured me that she would choose a surveyor who would complete this quickly and then provide the report in a quick turnaround. I didn't question this as I got my own home buyers report (done in October I add!) back after 72 hours of the survey being completed.

The Survey did not happen until 02/12 and now the surveyor is saying that it's not going to be done until at least Monday (09/12) - I'm now panicking that we're not going to be moving until after the New Year as quite understandably the top of the chain don't want to be moving a week before Christmas. Our buyers solicitor is insisting she needs the survey to exchange which I know is not the case as it's not a legal requirement. I know it will confirm if there's an subsidence or not but she lives round the corner from our house and none of the houses in this area have ever suffered from subsidence.

Just to add, we completely renovated this house - the electrics are new with a electric cert, same with the central heating and boiler with all certificates and receipts given. There is a new kitchen, bathroom and the whole place was redecorated. There are no leaks or damp spots. You can see from the outside that the windows have been re-pointed and we have provided FENSA cert for the new french doors. The house was built in 1993 and is fully insulated which the buyer physically went up into the loft to check.

I'm desperately trying not to get stressed - but what kind of pressure can I place, if any? The surveyor was recommended by our Estate Agent broker which I've since found out shouldn't of been done but clearly the surveyor is not worth their salt!!! Can I start having a go at our Estate Agent since they recommended and push them to do more? Do I throw the pregnancy card out there as I'm classified as a high risk pregnancy?

I'm just conscious of who's above us in the chain and their situations - I don't want our buyers inefficiency causing them upset so close to Christmas!

Any advise would be welcome as I'm in between wanting to cry or screaming at someone to do something.

    If you take emotion out of the equation, you are expecting a 3rd party to do something sooner to suit your own needs.

    You have no control over the 3rd party as there is no contractual agreement yet.

    All you can do send them a polite request.

    PS: Getting stressed is not good for the baby.
    Happiness is buying an item and then not checking its price after a month to discover it was reduced further.

    I would normally agree - pregnancy aside I'm quite logical and aware delays happen. I think what I'm frustrated about is that she agreed with the timeline and now is doing very little to improve a situation she's created...the response received back so far is that she would contact the surveyor to see if they could give verbal confirmation but not today.
