Euro Car parks Wimslow

Good Evening,
Have read the Forum but not quite sure as to best way to progress.
In early October the driver entered the Miller & Carter car park in Wimslow at approximately 19.00. (In darkness)
The driver spent the evening inside the venue but was unaware of the requirement to register their vehicle.
Subsequently the driver has received a NTK with the usual demands.
The driver will be complaining to the Miller & Carter management along with an appeal to Euro car parks.
Please can someone advise as to what the basis of the appeal to Euro Car parks should be given that their response will likely state that their signage advises of
their terms. The driver was not aware of the requirements and was not informed by the staff of the Miller & Carter.
Please can someone point them in the right direction.

If the local manager is unhelpful a polite complaint to the CEO Phil Urban stating how disappointed you are that your meals have attracted a £100 surcharge and your family are unlikely to return.

Just so you understand the reasons for the NEWBIES BLUE template appeal:-
1. It doesn’t identify the driver.
2. The PPC will recognise you are receiving forum help - some are inclined
to put these in the too difficult pile.0 -
Failure to enter a VRN is regarded by many judges as a trifle, unworthy of a claim for breach of contract, read this
https://en.wikipedia.org/wiki/De_minimis
Nine times out of ten of these tickets are scams so consider complaining to your MP, it can cause the scammer extra work.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking CompaniesYou never know how far you can go until you go too far.0 -
Thank you for your advice.
I have read the blue template appeal letter but it doesn't really relate to the situation at hand i.e. Failure to gain authorisation by registering the car number plate.
The first two paragraphs make sense but the rest is in respect of PDT's or overstays.
The NTK states:
Your vehicle was not authorised to park
The vehicle was parked at M&B - Miller & Carter - Wimslow, by remaining at the car park without authorisation, in accordance with the terms and conditions set out in the signage, the Parking Charge is now payable to Euro Car Parks (the creditor).
Does the appeal letter need modifying or should the driver send it as written.0 -

It relates precisely to the situation at hand.
The keeper got a PCN.
The keeper wants to appeal without revealing the driver's identity.
The keeper wants to alert the fact they are receiving forum help to the scammers.
The regulars, including the person who wrote the NEWBIES have told you what to do. Go against their advice at your peril.
Have you complained to the landowner/manager yet?

Modifications are okay as long at you don't slip up ... the template's a safe way of appealing in order to get a POPLA code. ECP will almost certainly reject it regardless of what it says.0

Yes it does. You clearly haven't read the rationale for sending it either in the Newbies thread or in post 5 by Egbert Nobacon.0 -

Think before you respond to this post! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
