PEA parking charges

Someone i know has recently been issued 3 parking charge notices (within the same week) by PEA Parking and enforcement agency, due to parking in the car park of the hotel that they were employed by at the time. Said employee was told by previous management that their number plate could be exempt on occasions when parking was required to make it to work on time from other commitments. The employee informed management of these parking charge notices from PEA at the time and was told they would be ‘cleared’.

Unintentionally they were not cleared, and said person has now received 3 more letters from a company called Ultimate Customer Solutions, now demanding £170 on each letter rather than the original £65.

Management in the hotel has now changed and informed the (ex) employee that employees are not entitled to park in the hotel car park under any circumstances so are refusing to clear these parking charges. This is clearly a misunderstanding between the hotel and the employee who has been misinformed, and would simply call for the land owner (or a manager from the hotel) to cancel the charges by sending an email. I find it very unreasonable that they are refusing to do so, even after the previous manager visited on behalf of the employee to explain the situation.

It only takes a google of PEA (Parking and Enforcement agency) to make me question the legitimacy of this private parking company and whether these ‘charges’ and letters are just scare tactics to be ignored. We are reluctant to go through the PEA appeal process, as if i am right they cannot hold the registered keeper of the car liable without proof that they were the driver? Would it be better to just ignore future letters if the land owner will not clear these parking charges through PEA. And what would be the result of this.

Any advice would be much appreciated!

    as these are with the debt collectors there is no chance of any appeal , that ship sailed long ago (usually after one month)

    its either pay in full or take your chances in court

    due to the circumstances its either a KEEPER led efence hiding behind POFA , because they can only hold a keeper liable if they complied with POFA , even if they were not the driver

    a driver led defence doesnt use POFA and so the circumstances of permission to park etc by the hotel come into play , so a driver defence based on having landowner permission and exemption from the parking restrictions

    the latter seems better to me , rather than hiding behind POFA and squirming when asked if they were the driver or not , yes or no answer, no lying (perjury)

    if it were me I would take my chances in court

    PEA have 6 years to try a court claim

    Nine times out of ten of these tickets are scams so consider complaining to your MP, it can cause the scammer extra work.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.


    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.

    Sorry my bad i should have been more clear in my original post - the first letters were for a parking charge of £100 in 28 days - however this was reduced to £65 if paid in 14 days.

    So does this still apply?
