Appeal still available as an option?

Firstly, apologies for starting a new thread - I've read the stickies extensively and there are various cases with elements like mine, but I can't find something which reflects the same scenario.

From my research I think the RK needs to work out if it's still worth raising an appeal for the PCN in question

Events :

- Around the middle of June the driver parked the vehicle in question in a car park 'managed' by PPC company "Local Parking Security Limited". It was late in the evening and raining and such was the haste of the driver, they inadvertently entered the VCN of the incorrect vehicle, a vehicle that is also registered to the RK of the vehicle placed in the car park.

- The driver placed the ticket in the car in question and then left the car park within the allotted time for the ticket that was purchased.

- The RK had not kept the V5 certificate up to date and had moved earlier in the year, although this has now been rectified in the last couple of weeks.

- Yesterday the RK of the vehicle received a (first) letter from DRP plus stating that £160 was owed for the incident in question. As the debt had been passed to them by their client LPS Ltd and they had to use a tracing service to locate the RK.

So the RK needs to assess whether they can still reasonably appeal the PCN (obviously they wouldn't contact DRP), but potentially Local Parking Security Ltd directly?

If they don't do this, presumably they should contact the PPC to update them with current address (presumably not contacting DRP as they already have a current address based on tracing)

Hoping you wonderful experts can assist, I suspect it's a straightforward answer. The RK would obviously rather not receive 6 years of Debt Collection letters when the driver paid for the parking fully and in good faith and there has been no financial loss to the PPC in question.

    Yes, appeal direct to the PPC. It will probably be rejected even if the keeper adds a one liner that the NTK was sent to an old address. If it gets to court it can be shown that the keeper acted reasonably and tried to engage with the scammers despite their made up appeal timescales.

    Send a rectification notice to the PPC's DPO giving the new address for service and instructing the old incorrect address to be erased.

    Complain to the landowner.

    Complain to your MP about this unregulated scam.

    You are correct about ignoring DRP. They have the keeper's correct address so nothing needs to be done with them.

    Also get photos of the site and signage as soon as possible.

    Nine times out of ten of these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
