Cps midlands threat of court action

Have read the Newbie thread and various others but feeling a bit lost with this so could use some advice.


Back in June the driver was issued a pcn by cps midlands. They had parked by a climbing dept just for 5 minutes while they picked something up from their office (and were still several spaces free). They returned to the car and were just checking a message on their phone before leaving when a man pulled up with no uniform or Id (and actually parking on double yellow lines) banged on the window shouting that the driver couldn't park there and proceeding to start to write out a ticket. As the driver was still in the car they had no way of knowing if they were actually a customer or not. The driver felt quite intimidated and told them ''I'm leaving, I'm leaving' and drove away but not before they had stuck the pcn to the window. It felt uncertain whether this was legitimate due to the circumstances so the pcn was not paid. Eventually I received the NTK just within the timeframe. I got a bit confused with when to send the standard appeal and who/where to and think I may have missed the deadline on this. I have now received some debt collected letters from TNC which I had ignored but today received a 'notice of intention to advise client to issue summons' unless I pay the £160 within 7 days. I am anxious at the thought of going to court but also very reluctant to pay this unfair and excessive charge. An e mail of complaint has been sent to the climbing depot but there has been no response.

Any advice on what I should do from here appreciated!

    Usual BS bluster designed to spook the unwary - and it seems to have worked with you. Most people would now be writing out a cheque to TNC - fortunately you've come here before doing so! Just ignore the idiots.

    If the car park was left in a hurry with the parking gimp scrabbling to write out the ticket, he may not even have had the opportunity to photograph the vehicle? Were there photos shown on the initial letter you received? Check their website to see if they have any timed and dated photographic evidence of the parking event.

    All a bit academic because I can't see this going anywhere further, but just satisfy your (and my) curiosity.

  • Never phone tnc they are a nasty lieing bunch
  • No photograph on the notice to keeper letter. Don't think there can be one. Is it the tnc website I need to check?
