Rest breaks

Hi I am contracted to work 2 set days a week for 9 hours each day. Now my boss is trying to make me take an hour out of each working day for my breaks. Can he make me do this?

  • Well you can't really go nine hours with zero breaks

What does your contract/staff handbook say about breaks? Are they paid or unpaid breaks? A lot of companies give in excess of the legal minimums.

My employee handbook says unpaid breaks of 20 minutes if you work over 6 hours. Doesn’t seem to matter to him.

    Why?

If he is a manager with the authority to determine such things, then yes, he can make you do it.
  • He can’t change policies just out of the blue.

    Follow your contract.

Are you being paid for the other 40 minutes he wants you to take as break?

Was there custom & practice that allowed more than 20 minutes break during the 9 hour shift but was never officially sanctioned?

What's your union's advice about it?

How did you get on with your previous employment grievance about being promoted to team leader, but not officially, and then not applying for the same role as it was discriminatory. You never did say.

Tell him you'll be delighted to take an hour break providing he pays you for it.
    Don’t be a can’t, be a can.
  • how long have you worked there?

I have worked there for over 10 years. I believe I am not being paid for the other 40minutes.
