The juggernaut cannot be stopped , not until a judge stops it , pointless looking for ways out of this , a court claim has to be defended by the claimant , even if it means pointing out those issues in the defence , adding abuse of process and getting it struck out due to the wrong person being named on the claim
Not sure where the 15 days comes in , but the court claim needs the AOS doing online to give 33 days from the issue date for a defence to be submitted , even if that defence is about the wrong person being in the dock
A judge will decide this from now on , be it on papers or in court , but they may strike it out as the wrong person is being pursued , but it still needs to go through the motions , it cannot be sidestepped , it needs to be hit dead on and recriminations left for later
If they are wrong , then a judge should strike it out , that is the acid test
I would let the other thread deal with the court claim , and add the name of the claimant , issue date , POC and charges plus total , get the defendant to do the AOS online asap , then start drafting a defence , no more beating around the bush or what ifs0 -
What is the Issue Date on the Claim Form?
Did it come from the County Court Business Centre in Northampton, or from somewhere else?0
