I've seen some really helpful replies on here and was hoping someone could help me too!


The keeper of the car just received two PCNs from Fistral Beach, Newquay . One notice is from the parking company, the other is from a debt collection company although the original notice was never recieved. Both PCNs are past their 28 day appeal period so it's not possible to appeal through the companies website and they only give a postal address as contact details.

On both occasions, the driver definitely paid for all the time they were there. They topped up the initial ticket to extend the time. The ticket times did not match up exactly but there is a sign in the car park saying "addition time can be purchased from the payment machines before exiting the car park" so that should've covered them.

For one of the dates, The driver still has the tickets but not for the other. Extra time was definitely bought the other time though because The driver remembers having a long conversation about it at the time.

The debt company were no help. The keeper has contacted the British Parking Association who have said that they will forward the appeal request via email to the company asking for a late appeal to be accepted.

Any suggestions would be very welcome! I echo other comments on here that the operator shouldn't get away with this scam - total fines in the hundreds! MP will be contacted once it is resolved,

    Edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people. ;)

    Next, read the sticky thread or NEWBIES. This explains why you should never, ever contact a debt crawler. There is also a ready written appeal in blue text The Keeper can send by post, first class from a PO counter and obtaining a free proof of posting.

    You could also send the appeal via the BPA, but since they are paid by parking scammers, don't expect them to be on your side.

    So, if this Initial Parking, you know what to do from all the other Fistral threads...

    Quick query, I'm going to send the TEMPLATE ''ONE SIZE FITS ALL'' FIRST APPEAL THAT DOESN'T SAY WHO WAS DRIVING from the other thread.

    Should I attach the scans of the tickets that were bought or does that contradict the content of the first appeal which is about not having entered into a contract.

    the KEEPER is appealing any pcn, not the driver

    the keeper has obtained the receipts from the driver and is submitting copies as proof of purchase by the driver with their KEEPER appeal

    I hadnt realised that yet ANOTHER parking company (Initial) was operating this car park , the previous being SMART and before that PARKING EYE


    seems to change more often than people in the cabinet !!!


    so as an aside , I have never heard of INITIAL until now but the 30 years they say they have been operating (on their website) doesnt seem to tally with their companies house registration , lol

    Complain to The Tourist Board, local pares and radio stations, tFacebook and Trip Advisror pages, the land owner, the local MP and your own MP, these companies are harming the local tourist industry. Nine times out of ten these tickets are scams and will fail in court.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    As predicted the BPA have returned my request to forward the appeal with the excuse that I have to try every contact method provided by the PPC. They have now not responded to my last email from over a week ago.

    I'm going to write directly to the Fistral PPC with the suggested Blue appeal wording. I've been reading around the threads and was going to pre-empt the response that says it's with the debt collectors now by adding a couple of paragraphs. Would you mind having a quick look? With my minimal knowledge, all the threads seem to have slightly different to contexts so I don't want to say anything wrong.

    Also, is it acceptable to inform the debt collectors over the phone or do I have to write to them too?

    I am writing to you because I received the PCN XXX more than 28 days after the issues date and the usual appeals procedure online was therefore not available to me. While investigating how to respond, as you do not have any means of contact other than postal mail, I have received a debt collector’s letter. I am contacting them and denying the existence of any debt. They will be told to refer the matter back to you and not to contact me again.

    There is nothing to prevent your company from accepting a challenge at any stage. Refusing access to your industry’s alternative dispute resolution procedure would be unreasonable and breach of the civil procedure rules.

    I am writing to you because I did not receive PCN XXX, I was only received a of a debt collector’s letter notifying me that you had issued a PCN. This means that the usual appeals procedure online was not available to me. I am contacting Debt Recovery Plus and denying the existence of any debt. They will be told to refer the matter back to you and not to contact me again.

    Furthermore, I have two parking tickets that the Driver has passed to me confirming that the correct amount was paid to cover the amount of time the car was in the car park. Copies of these accompany this letter.
