bank holiday entitlement

Hello MSE, first time poster, long time lurker.

I have a question in regards to bank holidays that i couldn't find an answer to elsewhere and dont feel comfortable bringing it up with my employer until i know a bit about what im dealing with.

I work on a 35 hour contract. I work 9 hours a day 4 days a week (minus breaks is 35), the days in which i work are in no particular pattern, just planned around the business' needs. one week it oculd be weds-sat another it could be tue-fri and another could be mon-thu. however. 35 hours i work is a constant.

My Annual leave entitlement is 28 days in addition to 8 days bank holiday as stated in my employee handbook.

My question is if i am entitled to receive a day in lieu (or a days pay depending on how they want to manage this) if my rostered day off was on the bank holiday - example in point, monday the 6th was a bank holiday however i am working weds - sat full fulling my 35 hour contract but i dont feel as if i benefitted from the bank holiday in any shape. yet if i was to work mon - thu i would have only worked 26 hours this week due to having the bank holiday off.

I hope this makes sense as its confusing for me to comprehend, let alone write about it, which is why i want to get my head straight when i approach my employer.

    If you've not used a days holiday for the bank holiday then you still have that days holiday to use at a later date.

    If you were working Mon to Thurs then you would have worked 26 hrs and used 1 days holiday entitlement.

    Bank holidays are no different from other days as far as employment law is concerned. And your employer can tell you when to have any or all your holiday.

    it is in my contract that i receive 8 days bank holiday in addition to my 28 days annual leave entitlement.

    if i was due to work this Monday but took it off because of the BH i would have worked 26 hours and used 1 day effectively taking my bank holiday days off in my contract down to 7

    However because i am working weds - sat, my full contracted hours of 35 my bank holiday 'pot' remains at 8 and i get to take the 'lost day' as an extra annual leave day

    Correct. Your pot remains the same as you didn't take the day as a bank holiday. If you had only worked 26 hours that week and had taken a day off for bank holiday your pot would be reduced.

    28+8 is very generous for a 4 day week worker that's 9 weeks

    statutory is only 5.6 weeks.

    Have they prorata in any way?

    do you use 4 days or 5 days when you have a week off.
