Help the accident claim

hi all,
This might be a bit long winded but i've run out of options and im after some advise on the way to go forward.

i have a new for old car accident policy with swift cover (axa)
my car was in a collision where the 3rd party has accepted full liability via there insurance company churchill.

my car was purchased at 27K only 6 months ago (from new myself as the only registered keeper) when it was impacted by this driver. Now churchills independent valuation report said the damage was 18.5K to repair it with the chassis twist it is a write off and offered me a good offer of £23400 however i didn't have gap insurance so was going to be out of pocket and took the advise to use my new for old on my policy.

So i contacted Swiftcover and they said if the car was written off i would be paid out the market value if the car is no longer available (which it is not Ford focus Mk3.5 ST3 model)

So the car went to copart for evaluation, they have 100% wrote the car off with the chassis damage. Now here's the funny bit. they are quoting 65% damage to make the car a write off but are also quoting a 51% damage to repair the car but are not able to due to the chassis issue.

every time i talk to them we are going round and round in circles and the best bit is the 51% they told me does not include the chassis as thats non repairable.

I've tried to speak to there managers to get some sense but continue to round this loop. any advise or questions welcome

Needed to add that swiftcover need 60% damage to be a new for old (but there not counting a new chassis in the valuation? confused!!

Whenever you are not happy with your insurance company the route to go down is a complaint in line with their complaints procedure

Then if you are not happy with the reply or they ignore you for 8 weeks you can escalate to the FOS for their adjudication at no cost to you
