Car claim fiasco!!!

So I ended up in not good situation last Monday night where I was in an accident in my car. A dear jumped in my way and in my attempt to avoid it I hit a tree.
Thankfully it was only me in the car my kids were not there and no one else was involved.

Car was taken away by recovery truck and I got taken home very shaken up but at least in one piece.

My insurance was contacted and have now had horrible treatment by them.
I’ve finally just been given a value of what they will pay for the car being written off. Car seats have been sorted was originally told by BACS for the seats but have been issued a cheque now apparently.
I’ve asked about what happens with injuries side of it I have got from the incident.
The claims handled accuses me of not having personal cover. I do have this the basic that is covered just for myself under my fully comprehensive cover and got transferred to customer service to bring that up with them that they have told me this when I don’t.
Got rudely cold transferred to that team only to be told yes you do have personal cover it is only up to small amount. But couldn’t be put back through to claims as they had closed.
I’m so annoyed at my last few calls and treatment by them.
The claim handler said even if I was to have it they won’t cover my injuries and pain I’m having from it.
Is this right can do this?

You obviously cannot claim any injury compensation as no third party to claim from

Read up in your policy to see what if any insurance cover you have for injuries

If you do have some cover and are not happy with your insurer refusing this cover then the route to go down is a complaint in line with their complaints procedure

Then if you are not happy with the reply or they ignore you for 8 weeks you can escalate to the FOS for their adjudication

In respect of injuries, it would be unusual for a Motor Insurance policy to include any significant or meaningful cover for Personal Accident. Some policies may include a small extent of cover, but probably for death.

Therefore, you will need to seek compensation from any negligent person/company/etc - that's the only route that I can see - i.e fault of local authority for damaged fence letting the deer escape.

    Or sue the deer !!

This thread covers much of the same ground on personal injury, although with a different type of insurance.
