CCJ has come back

Hi,


First time on the forum, could really do with some advice.


About 10 years ago I got several store/card credit card debts. I just stuck my head in the sand, tanked my credit score and eventually all letters and threats stopped. Not the best move I know. All have given up apart from one 'Link Financial'. Recently they sent me a threat to take me to court, nothing new apart from this time they attached a case number... I thought it may relate to a CCJ which I vaguely remember (another thing I just ignored).



I sent them a 'prove it letter'. They responded with no proof but have sent me a letter explaining that a CCJ was served and I can contact my local court to confirm with a reference number.


Do they still have to prove the debt? Will the courts have proof?


I'm getting worried as my credit score is finally on the mend. Would a final settlement be a likely option if I can borrow the money? What's the best way to go about it. My debt is just under £1500.

    No they don`t, a court has decided you are liable,


    This sounds like it all happened a long time ago, does the CCJ still show on your credit files ?


    CCJ`s do not go statute barred, however, if enforcement action is not taken within 6 years, they would need the permision of the issuing court to proceed now, this may, or may not be granted.

  • Seems it is a very old one then. You could try your local court to see - use this one

    Or more likely it will be Northampton Bulk Claim Centre whose address is here. Call them and they will confirm from the case number

    As CCJ's don't go away, you pay (at a negotiated rate or discount) or try for a set-aside if you have reason to do so e.g. not getting the claim paperwork.

    If you pay, it will be marked "settled" or "partially settled" (if you offer part settlement) and will affect your credit for a few years.

    Since the damage is done already, then paying in installments may be easier on you but as it is over £600, the creditor has the option of stronger collection methods e.g. bailiffs.

    Not really but it is part of life's education. Hopefully you won't make the same mistake again as you now know there are people out there that will take full advantage of your indecision in dealing with these issues.

  • It's no longer on my credit file, my credit is fairly good at the moment. I'm trying to build my credit up again. I guess I'm asking the best way to avoid damaging my credit. Obviously paying the full amount would be an easy option if I could actually afford it. That's why I'm thinking a settlement, if i settle with link directly will they mark my credit file at all/revive the CCJ?
  • Give the local court a call or Northampton a call and get the date of the CCJ.

    It may be that it is over 6 years old and has been removed from the credit file. It's still there as they don't go away but collecting on it has issues for them - which is why they pay so little for these and rush them to a CCJ to "uprate" the debt.
