URGENT HELP - Motability

Hello everyone I’ve not long been banned for 5 years from being able to lease a car for 5 years under the motability scheme and I was wondering if I could testify the interview?
The story is a family member rang my brother and asked if we’d collect them as they was drunk and said someone was trying to beat them up, so I’ve gone there to collect them and they put a box in the boot me being unaware of anything went home like normal, I went out in my mums car when I got back the police was crawling all over the motability car and said it was involved in a buglarly and arrested my brother as he was in the car listening to music. Anyway he was let out he wasn’t convicted as there was no evidence he was there. Motability was notified and they interviewed me but I was threatened to lie by someone and for my own safety had to lie to the interviewer who came out. The same day I had a procedure in hospital and was waiting for results for a serious illness and was under a lot of stress and me being vulnerable as I am I lied. Well they detected I lied and ban me for 5 years for lying.
Is there anyway I can testify and get my psychiatric nurse to say I wasn’t actually fit for interview? In my opinion I don’t think I was I have severe mental health problems and many physical problems. No fit for interview process was carried out? I’m on controlled drugs / opioids for pain relieve witch was in my system when I was being interviewed.
My healths detiorating 50 times worse and I can’t move I need the car.
Please help!

Tommy,
when you were interviewed were you under the influence of the strong medication you mentioned in your other thread? If so, that might be additional grounds for asking for reconsideration.0 -

Hi yes I was, I currently take morphine, tramadol, codeine and a new prescription of Amitriptyline; all for pain. I can’t remember what one I took on the day but I was definatly all spaced out even the interviewer said ‘you look really ill’, I just know they’ve been so hard on me I wonder how to go around the whole process.0 -

Are you allowed to drive with all those drugs in your body?0 -

Just buy yourself a second-hand car, might work out cheaper.
I was gunna do that but Because I don’t plan to drive, I want my carer to drive for me and it will work out to much to buy a car and insure it for an under 25 I won’t survive.0 -

I thought so.
Either write yourself, preferably with the help of someone if needed to Motability and say something along the lines of the following:
"I am writing with respect to the recent decision to disqualify me from Motability for 5 years. I would appreciuate you reconsidering the decision for the following reasons.
I confirm that the information that I provided to Motability was incorrect and that I should not have done so. I also confirm that I appreciate that under normal circumstances Motability has entirely fairly cancelled my entitlement.
However, I wish to bring to your attention that when I was interviewed my judgement and ability to be fairly interviewd was compromised for the following reasons.
1. I am currently being treated for anxiety and depression and other conditions.
2. On the date of the interview my condition was exacerbated because I was waiting for the results of hospital tests that were potentially life changing.
3. During the time the situation that led to the interview occured and during which I was an innocent party and there has been no suggestion otherwise.
4. I had been pressuried and felt under threat and vulnerable to give the version that I provided.
5. Whilst being interviewed I was under the influence of heavy prescription medication including morphine, tramadol, codeine and amitriptyline which rendered me incapable of good judgement.
Under the circumstances whilst I fully acknowledge and accept that the information I provided was wrong and that Motability unaware of the above reached an understandable conclusion, I am requesting it be reconsidered on the basis of the above factors and that it is absolutely clear that I was incapable of exercising reasonable judgement whilst being interviewed and that my judgement was understandably impaired.
I would appreciate you reconsidering this as these circumstances are exceptional and if your decision is unchanged how I can proceed with a formal appeal.
etc.... "
Does that draft reflect accurately your situation?
Good luck and the best of wishes.0 -

I already made an appeal and they suggested 7 year ban but they chose 5, I just took it on the chin but today I realised I wasn’t even in my right mind.

It’s a pleasure. Also add in your letter that you are 17 which I missed out in the above. Let us know what happens and if you feel you want any further help.
I hope your health improves and you get this situation sorted. Good luck and keep your chin up. Just remember that when you feel really bad that somewhere in the world at this very moment, there is a boy who has just dropped his icecream .....:D0
