    Thought it was £19?

    So...have they fought the case?!

Have you seen what their replies say on TrustPilot about people who chargeback?

Definitely £20. I just read the reviews, I did chase every communication to ensure they were still going to support the case and they did actually reply reassuring me of this, but I just don't trust the service when it's now at this stage, so I would rather deal with it myself now so that I know it is taken care of! Up to now I hadn't thought about whether or not I had a defence, I believed that they would have a case since they reassured me there was! I just don't know now if i actually have and whether Id be better to pay up! I kept up to date with the forum and saw all the posts about successful claims so that kept me going!

Good to see you have confidence in us but what have they done for the money?

Nothing so far, except advise that they have requested all correspondence be sent to them from CEL but I have received every letter up to now, and they have asked for a copy of it every time, I guess to prepare for this stage. I just dont feel comfortable leaving it in their hands and would rather try and fight it myself..
  • Do you suggest I use the fact they can't determine the driver (hoping it wasn't mentioned in my inital appeal) and lack of physical contract as defence?

what about the no lines in the car park? Could that be used in the defence?
I think you're clutching at straws. How would a lack of white (or any other colour) lines help a defence?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This point was raised in another defence on this forum
  • Hi everyone.

I have been to the car park this morning, half of the car park is free, the other half has a parking restriction (belonging to two different businesses, but their car park is joined, you have to go through the free car park to get to the restricted car park) under the main sign is another sign with 'Data Protection Information' listing the necessary info. Then on the smaller signs it says 'If you exceed the parking allowance you agree to pay £100. These terms apply at all times. Additional costs/recovery will be incurred if payment is not received within 28 days'.

Is someone able to tell me whether I should use the information about the two car parks, one restricted one not in my defence?

If it caused issues for the driver, and confiusion, of course you do
For example if it is NOT BLINDINGLY OBVOUS you are now in the "pay" area, then this of course is a problem for the parking company.

Hmmm, and what about your money wasted? What service have they provided?

Not much of a service, only when I was more demanding asking for them to respond to my previous email!!
