East Midlands Airport parking charge

Hi guys, looking for some help with this.

I went away from the weekend and paid to park in the short stay car park at East Mids. I've parked in the short stay before, so assumed it was the same as usual. When I tried to get out, it turned out I'd parked in the wrong short stay car park and should've been in the one around the corner. I now owed an additional £70.

I completed a non-payment form and now have 10 days to fight the charge, due to a mistake which apparently happens 'once a night' according to the guy at the desk.

What do I do about this when I call, have you ever heard of anything this ludicrous before?

You are not going to phone anyone are you. PCNs are not disputed by phone, for obvious reasons of evidence and a paper trail.

Who issued the £70 and is it called a 'PENALTY'?

Can you show us a copy of the notice (host in Dropbox). Change the http to hxxp and/or change 'www' to 'xxx' to get around the ban on newbies posting a working link (make it non-working but sensible for us to see and convert).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

There's a paper trail in that I had to give my reg, name and contact number in order to be let out through the barrier. All they gave me was the torn off bottom of the page which just says

'East Midlands Airport Part/None declaration form

I understand to remit the amount of £(70 written in pen) within ten days. I understand that failure to comply with this undertaking renders me liable for action to be taken for the recovery of the debt and costs incurred. '

Then there's my signature and date. They didn't make a copy of this.

I meant to dispute this, it must be done in a format that has a paper trail.

A CARDINAL RULE - NO PHONE CALLS, OBVIOUSLY, FOR ANY SORT OF PCN, EVER.

I would wait and see what they send to the registered keeper in November (they will get the rk's data from the DVLA) because then you can see what they purport the issue is - breach of a bylaw or what? THEN the keeper can dispute it.

As long as you are the rk, I would wait for that as that scrap of paper is nothing and tells you nothing about the basis of claim/charge.

Thanks, I'll hold fire then and see what's up next. The guy in the office seemed confident they wouldn't pursue it, but also that he wasn't to know as he wasn't involved with that sort of thing. I guess we can only see.

Surely this isn't the run of the mill PCN?

Did you pre pay to park in a short stay car park, but then park in a different car park to the one you booked that was more expensive?

In which case surely you have incurred an additional parking fee for a more premium spot, not a PCN or penalty.

Being a rip off airport the parking fees paid on the day are even more extortionate.

I may be wrong but I wonder if this really is a different situation to the normal scams we see here?

Horrible little airport, with extremely confusing filter lanes for the various car parks/drop offs etc, and if you end up in the wrong lane you cant escape as instead of white lines, there is steel fencing. as a bonus the road markings are worn/hard to see.

It is different, as it issued by the Airport themselves, but it's still a penalty IMHO and the basis of it is very unclear to the OP, and the car parks were not clearly separated/signed.

Hence I would wait and see what the Airport's letter to keeper actually says about the basis of this £70 'penalty' (breach of byelaw, or what?).

We've seen these on odd occasions over the years.

Hey its exactly that. I paid the most expensive price to park in short stay. Turns out I was in short stay 3, not 1. I was told by the man in the box that short stay 3 is elsewhere. Naive on my part but also not obvious at all. I snapped a picture of the entrance that says in big letters 'short stay - pre booked and pick up' which sounded like me. There's a smaller sign beneath, 'short stay 1 & pick up only'.

I think that they would struggle in court (Magistrates)? as they appear to have suffered no loss.
