Is this boiler flue compliant?

I've just had a combi boiler installed in my first house - the location is the same as the old system boiler.
The flue is directly underneath an openable window (opens from the bottom) so the plumber installed a plume kit which takes it up past the window, and when it gets to just over the top of the window frame, it turns and points out away from the window.
Is this compliant with building regulations?

Flue should be a min of 300mm below the window, a plume kit shouldn't be used to get over building regs or manufacturers instructionsI'm only here while I wait for Corrie to start.
