Neighbour disputing party wall AFTER they sent us a consent

We have been contacting our neighbour for sometime about possible extension works. They eventually agreed that they would consent to the party wall notice on condition of a schedule of condition being made, which they also agreed to pay for.

We sent the notice, they replied saying they agreed (with a small amendment regarding the schedule of condition).

They since contacted a Party Wall Surveyor to do the schedule of condition, and the party wall surveyor has convinced them to dispute instead. We have now received another letter saying they dispute it.

Does this second letter override the first one? After all, we have it in writing they are happy to go ahead with the work.

    Yes, once the process has started a dispute can be raised even if the adjoining owner originally gave consent.

    Hardly surprising really, the building owner (you) should pay for the condition survey so the party wall surveyor has simply pointed out the error.

    Now you are in dispute you will have to appoint your own surveyor or agree to use the neighbour's surveyor as a joint agreed surveyor.
