Does the receipt of Universal Credit override the Mandatory Reconsideration process?
The facts: I was in receipt of ESA until I had my health assessment. I was found fit for work. I took advice from the CAB, who said that I should request a Mandatory Reconsideration as their decision was unfair.
In the meatime, I applied for Universal Credit. I also had an advancement of this at the job centre. This is in the form of a loan, which I will have to repay.
In the meantime, the job centre want me to log into my journal on the Universal Credit website to set up the rest of my account and confirm my identity, etc. My question is: By doing so, am I running the risk of having the Mandatory Reconsideration cancelled? Will my UC claim override the MR?

MR process under ESA has nothing to do with UC at the moment. However, you should tell UC and your Work Coach to make a note that MR process under ESA has been requested.
If the MR is successful, then ESA should tell you what you need to do. Also tell UC and Job Centre of MR outcome. If you are found to have Limited Capability for work (LCW) or Limited Capability for Work and Work Related Activity (LCWRA), then these are recorded on UC claim. LCW only attracts extra payment if you had this running before 3/4/17 and no more than a month gap between ESA and UC. LCWRA award attracts an extra payment of about £328 per monthly assessment period.The comments I post are personal opinion. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0 -
