PCN from VCS for parking motorcycle on bicycle rack

Hi All!

This is my very first post on this forum so first of all I wanted to say great thank you to all contributors!

To the point:
On 01.06 I got PCN from Vehicle Control Services (Sheffield) for parking motorcycle in "restricted/prohibited area" (red sticker on motorbike windscreen). The bike was parked in a space between two buildings. There are posts informing about parking restrictions, however there also is a number of bicycle tubular racks. The motorbike was parked in one of them, however not chained to it.

On 07.06 I received NtK in the post. This I believe is fairly standard paper claiming that by parking there driver entered into a "contract" with VCS and demanding payment of £100 (or £60 if paid within 14 days).

After reading NEWBIES thread I conclude this is fairly standard case so I am planning on submitting appeal directly to VCS. I was going to use standard "ONE SIZE FITS ALL" template, but I was thinking if I should add more ground to my appeal, i.e. if the vehicle was a motorcycle, technically it is the same as bicycle (with addition of an engine), for which there where designated parking facilities. Is it not a contradiction that they are banning any parking but also put up facilities encouraging parking specific type of vehicle?

Any opinion on that would be much appreciated.

    You say you read the newbies thread.


    Throughout you are advised never to reveal who was driving. You need to remove details of who did the parking


    Follow the FAQ advice on sending your appeal - the template is designed to get you a popla code (assuming you are dealing with VC Solutions)


    (If you are dealing with VC Services then no POPLA of course anyway!)

    VCS Sheffield are IPC members.

    Just use the NEWBIES template exactly as it is. You will be wasting your time if you try anything else.

    Was the notice to rider one of the This is not a PCN jobbies? If not, the dates make the NTK non POFA compliant.

    Where exactly did I reveal the driver in my original post?

    VCS are member of IPC hence I will be using NEWBIES template for appeal.

    The notice to rider (red sticker on the bike) says "This is not a parking charge notice"

    Read up in the FAQ on the futility of appeals to IPC members


    Once you appeal then ignore everything except a lbcca or court correspondence


    They have 6 years to start legal proceedings against you


    You revealed the driver in the third paragraph.


    Use the third party to describe what happened ("The Driver" did this/"The keeper" did that etc)

    Sorry for being pain but I really can’t see where I reveal the driver in third paragraph. It’s all about hypothetical situation without reference to the case.

    I’ll read up IPC appeal in FAQ then.

    so whats a electric bike? , must be mechanically propelled , therefore they can ticket it?

    If its under 15.2mph assistance then it isnt a powered bike neeidng a licence to ride.
    Over that and you need a licence.

    Surely the signs don't say that £100 PCN will arise from parking a motorbike in the bike racks? No contract agreed, no clear signs at those racks.

    Not that any appeal will work, these cases are won at court stage so you are in it for the long haul but can be confident. Get photos now, in advance, in case they change/improve the signs at the bike racks.

    Also the rider didn't get a PCN on the bike, it wasn't a PCN, was it...so they say...
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
