Overpaid debt!

Hi,

Not sure where to post this so I'm sorry if it's in the wrong place.

I had a debt that was passed to Rossendales last year. I set up a payment plan and never missed a payment.

I've accidently overpaid the debt, I've emailed Rossendales about getting my money back but I'm not getting anywhere. I'd rather not call because of how much they charge you - any advice on how to get my money back?

    Write to them. This happened to me with another collector. I hadn't realized until one day some money unexpectedly appeared in my account! They refunded without me asking.

    Yes I would echo the suggestion to write requesting the refund, but also copy in whoever it is that Rossendales are acting for i.e. the council/court/original creditor. Hopefully it should be easy enough to reconcile you with that money as any enforcement fees are usually fairly rigidly determined, so any excess should be easy to identify.

    Great thank you, if I don't hear from them tomorrow I'll email again but will make sure the council are cc'd in so they are aware.

    So they replied, saying that the total owed was not £609.54 including fees as stated in every correspondence with them but actually £733.54. They have never said this total before, only when I asked for the money they owed me back.

    What do I do?! The total I agreed to pay back was £609.54, I have the emails from them confirming that that is the total owed so I'm loathe to pay them anymore!

    I wanted to send you a quick reply before the weekend, as Dennis isn't available at the moment. I would suggest you ask them for a breakdown of this 'new balance' and raise a complaint. Explain this is different to all previous correspondence and send a copy of the previous letters that show the different balance. Once you have the breakdown you can post the details to check the fees they have added are in line with the legislation.


    If this was for council tax you could also write to the council directly asking them to step in to help you secure a refund for the overpayment. If the council refuse to get involved you could write to the Local Government and Social Care Ombudsman. If the bailiffs do not satisfy your request (or have charged you fees they shouldn't have done) then you can escalate their complaint to their trade association, which could be CIVEA. Good luck,

    So much did you pay against what you thought was owed ?


    If you contact them they should be able to confirm the opening balance, any charges added - which will be usually no more than £310 and any payments or balance adjustments made.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
