PCP Enforcement Agency - Notice of Intended Legal Action

Hi All,

Some advice would be appreciated on this.

We have received a number of NtK, and subsequent notices from a period of time when my OH car was parked in a hospital staff short stay car park (where they work, with permit displayed) for a prolonged period as they were with a parent who was in ICU, not thinking about where they were parked - more thinking about the situation at hand in ICU.

I replied to a number of these NtK's, with the template letter from here stating the 5 numbered bullet points requesting information as follows:
1. Who is the party that contracted with your company and are they the landowner?
2. Is your charge based on damages for breach of contract? Answer yes or no.
3. Please provide photos of the signs that you say were on site, which you contend formed a contract with the driver.
4. Please provide all photographs taken of this vehicle.
5. Please provide proof that the timing of any camera or timer used was synchronised with all other cameras and/or systems & machines.


These letters were responded to by PCP here

Following that I have not replied, or heard anything further until this morning we have received "Notice of Intended Legal Action"

I'm not against paying sensible parking charges for the overstay, but at £100 per ticket with a handful received across the period - that certainly isn't reasonable. I/We have not attempted to discuss anything with them verbally at any point.

Appreciate any suggestions on how to move forward next.

    #2 there covers legal action from receipt of a lbcca right through to the hearing

    The letter claims to fulfill pre court protocol but doesn't!!

    With hospital cases, your should make yourself aware of the nhs parking principles for staff, patients, and visitors.
    Once you've understood the parking principles, you should then complain to this hospital PALS service.
    However post your complaint up here first.
    and removed the driver drove the car, and not I drove, he drove, she drove, the wife husband or anything else like that., the DRIVER drive and parked.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    What happened when she complained to the Facilities Manager? If not, why not?

    Looking at BMPA, not many end up going anywhere but still causing significant distress and bringing back memories of that emotional time.
    Am I to understand that they (PCP) believe this latest letter constitutes an LBC, and as such - we should be replying using information/links from Post #2 of the FAQ thread ?
    Or alternately, is this to be further ignored until an LBC is received from their "solicitor"?

    Ask them again how they are upholding the parking prinicpoles, and why they believe they can ignore tehir Minister?

    You of course respond to a LBC, because it says its a LBC.

    This letter makes it feel like groundhog day and going nowhere as they are still demanding monies and providing none of the detail requested as specified in the edited template letter replies sent to them.

    Any advice would be much appreciated on what to do next, if anything.

    now thats an interesting statement to make seeing as how the parking co , cannot apply for vehicle details or write to you untill day 29+

    on, the idiot legals will have their collars felt
