Rejected PPI Claim M&S by M&S and Ombudsman

Just wondered whether this decision by Ombudsman can now be over-ruled due to Pleavin outcome?

No the Ombudsman decision on whether you were miss sold or not is unaffected by Plevin. However M & S should probably review your case at some point if the commission earned was above the threshold, if it was you get a refund of the excess amount.

Thank you Will they do this automatically or should I contact them? I vaguely remember in their response letter about the ruling with regard to commission.

Its not automatic. You have to contact them.

However, be prepared, early indications are that card PPI is around 50% (some just below, some just over).
