Signed a housing benefit form paid 4 weekly in arrears

Are there any rent arrears?
Was the rent monthly, weekly or 4-weekly?
Did the 4-weekly HB
a) go to you or the landlord?
b) cover the full rent?
c) if it did not cover the full rent, did you mke up the difference?
However to answer your question, if no damage has been caused AND there are no rent arrears, then you should get back the £550 deposit.0 -
Are there any rent arrears?
No rent arrears I've actually over paid
Was the rent monthly, weekly or 4-weekly?
Rent was £550pcm
Did the 4-weekly HB
a) go to you or the landlord? Direct to landlord
b) cover the full rent? Yes
c) if it did not cover the full rent, did you mke up the difference?

if no arrears, no damage and you have left the property in the same conditions as when you got it, it should be full.EU expat working in London0

What I'm asking is what happens about the extra months rent money
As I have claimed from the day I moved in so one month was double paid0 -
You mean you started off by paying in advance even though the contract was to pay in arrears? You should get that back too, but I'm not sure why you paid a month up front in the first place...2024 wins: *must start comping again!*0

I think the OP paid upfront as you typically do, but the HB people ALSO paid from the date they moved in, the payments 'caught up'.
That money should probably go back to the council - not sure why the OP decided to pay direct to LL0 -
1) sounds strange that HB is paid 4 weeekly but rent is due monthly, and yet the HB covered the full rent. It is very likely there was a shortfall in rent.
However, you seem certain this is not the case, so....
2)
* does the tenancy agreement say rent is payable in advance or in arrears?
* you paid rent for 1st month yourself, in advance (as is normal), yes?
* 4 weeks later, HB paid the LL 4 weeks rent duplicating the first 4 weeks rent (but missing the remaining 2 or 3 days of the month), yes?
* HB continued to pay the LL 4 weekly covering weeks 5-8 and so on, yes?
* if so, the shortfall of 2 or 3 days each month would mount up........
* when you gave notice to leave, did you inform HB of the tenancy end date?
* when did HB make the final 4 week payment to the LL, and what period did that payment cover?
3) if an overpayment was made by HB, then the LL should repay that rent to HB
4) if there are arrears (though you seem certain this is not the case) you must make up that rent, probably from the £550 deposit (if it is enough), or from your savings
5) so you should get back at most the £550 deposit., but maybe less if there are arrears. HB should get back any rent that was over-paid.
6) note that if you ask the LL to repay to you any overpayment made by HB, that wuld be benefit fraud.0
