Hi all im confused about this situation.
I was on esa until a couple of months ago i went for a assessment and scored 0 points anyway i did a MR and sent in medical evidence and they awarded me 6 points. So still not past.
So now i have im waiting for an appeal. The woman on the phone said she would transfer me to jsa to make a new claim so whilst on the phone to jsa i had loads of problems because to claim you have to be fit to work, so i got a catch 22 situation i had to say i was fit for work even tho i wasn't. So now ive struggled to get down the job centre to sign on and have to do this once a week. So because i get PIP i get extra money on my jsa a disability premiums. So if i claim the assessment rate would i lose this and still have to go down the job centre. Thanks

There is a difference between being unfit for any work and being unfit for your usual occupation, but able to do other work.0

1) The woman on the phone gave you incorrect info.
When you have lodged the appeal with the Tribunal Service, you can request that ESA is resumed.
You will need to supply fit notes.
http://www.cpag.org.uk/content/benefit-during-employment-and-support-allowance-dispute
"The government has recently confirmed, however, that once a claimant has appealed, ESA can be backdated to cover the full period of the MR. It is, therefore, in a claimant’s interest that the MR is carried out as quickly as possible to enable ESA to be reinstated and any arrears paid, either as a result of a favourable MR, or the lodging of an appeal following an unfavourable MR."
2) Get help with your ESA appeal from your local CAB / advice agency.

This site has some very good info and a useful guide on appealing:

This is a helpful guide about benefit appeals. It deals with PIP, but the process is virtually the same for ESA:
