Atlas Choice administration

I have experienced the same problems as in this thread:

"Atlas Choice and GreenMotion payment problems"

Unfortunately, I cannot see anyone that has a similar case to me because I used two different cards. I have been charged twice. First by Atlas Choice (for which I used a debit card) and then by Locauto, the car hire company (on my credit card I left for deposit when hiring the car). The second charge was £35 higher than the original agreed price with Atlas Choice.

I contacted Sainsbury's Credit Card to question this and eventually they have decided this is not covered by Section 75 because:

"I cannot accept that a breach of contract or misrepresentation has been proven, as it appears the merchant have fulfilled their contractual obligations. The locauto rent noleggio were not paid for your car hire and so therefore had to charge your credit card for the car that you did receive. Your dispute is with the Atlas Choice transaction that has not been paid on our credit card and should have been taken up with your debit card provider."

Can anyone help here? Are they correct about this and is my only course of action now to try the debit card company or go through the administrators? Thanks.

    They suggest you buy a rental voucher from Atlaschoice, which is presented to the car rental company as payment towards the rental of a car.

    I've booked hotels via Agoda, who use a similar system. You buy a voucher from them and present it to the hotel as payment.

    Presumably, Atlaschoice had a commercial agreement with Locauto to sell vouchers for car rentals. And, presumably, when you collected the car Locauto accepted it as payment for the rental.

    You, presumably, gave Locauto your credit card to pay for damage, toll charges, etc. Not to pay for rental of the car.

    It's not your concern that Locauto didn't receive payment from Atlaschoice. Locauto should chase Atlaschoice for payment.

    When you gave Locauto your credit card details you did not intend them to be used to pay for rental of the car. You had already given them a pre-paid voucher for that. In my opinion, the rental charge made to your card by Locauto was unauthorised.
  • Just had a letter from an Italian car hire company for a rental back in Aug 2016, saying that Atlas Choice hadn't paid them the money for my booking and they were now looking to me to settle the bill direct or else they'll take legal action if I don't pay within 15 days.......can they actually do that?
  • I have also received the same letter today threatening legal action if not paid within 15 days ...unbelievable. Will be interesting to find out if they can do this.
