Hi,
I'm just checking Noddle online and everything seems to be OK except Shop Direct who have Arrangement to pay and then about 4 red markers showing payment 6 months late - they have been receiving £1 Token payments from Stepchange for the last 15 months - can I request a defaults back dated?
Thanks

Yes you can - although there was only 'guidance' from the ICO when I was doing this myself a few years ago, I doubt this has changed.0

Hi anna_1977,
You can make the request based on the ICO guidelines but Westminster is right, they are only guidelines. I can understand why you would prefer the default to be recorded (otherwise the debt will show for 6 years from the date of settlement rather than default) but the lender only needs to ensure that the data is up to date and accurate. So, if they are happy with the £1 payment, they may be able to justify the arrangement in place marker rather than a default (especially if it is being done through Step Change).
You can have a look at the guidelines and see if you can find any references to help your argument to default the account - http://www.scoronline.co.uk/sites/default/files/high_level_prinicples_document_final.pdf

Thank you, I think I will contact Shop Direct shortly and ask them to default and see what they say0
