My Rights When A New Machine Breaks Down

I recently purchased a brand new machine for my business, to the value of £25,000, I am only a one-man business. The machine has clocked up 30 hours work so far and now needs a new engine. The supplier has told me that the engine will obviously be replaced under warranty, but it may take up to 5 weeks for the engine to arrive, which is far too long, especially as I have lots of work for the machine. I phoned another dealer regarding a replacement engine and they have an engine sitting on the shelf, but because this is a warranty issue, I am told that it is not possible and I will have to wait, which I find amazing! The engine is Italian and Italians are not renowned for their quick response! I gave them the example that if it was a combine harvester it would be running the same day or at the very latest the day after!

I really feel that the supplier is making very little effort to get this issue fixed promptly, they have told me that they may be able to hire me a machine for me, although this is easier said than done as the particular machine isn't that common. The engine is covered by the engine manufacturers warranty, although I believe it still comes down to the manufacturer of the machine to sort the issue out.

Obviously, this is costing me money every day, my question is what are my rights of a situation like this? Also as always, I need to stay on good terms with the dealer (manufacturer) for spare parts in the future.

  • As it was a business sale, you don't have any rights under the Consumer rights act so you have to either rely on the terms of any warranty or whatever T&C's are written into the contract of sale.
    Why not see if you can hire a machine for the time that yours is out of use waiting for the repair?

    Unfortunately as this is a consumer rights forum there's very little advice we can give you.
  • Every business should have a back-up plan (not easy with the equipment costing £25k a time)
    How did you do it before you bought this machine?
