County Court Claim Form - ES Parking Enforcement Ltd - help!

Hello,

Brand new to the forum so go easy on me!

Sept I received a PCN in the post, no ticket left on my car so this was out of the blue, asking for £100 for parking in a car park, from ES Parking Enforcement Ltd which I ignored. Around 6 years ago this happened to someone else so did the same thing and ignored letters.

I then received another letter from ES Parking Enforcement LTD, asking for £125.

I then received a letter before claim from Gladstones Solicitors asking for £150. I ignored again (probably should have responded but from what I read I figured they'd give up or take me to court anyway regardless of any letter).

I now have a County Court Claim Form, and I am trying to do two things:

1. fill in the online form so i can buy another 2 weeks to complete my defence

2. Prepare my defence.

I'm after some advice on whether I should defend all the claim and also the form also asks me if I intend to contest jurisdiction, what does this mean?

From newbies section:
- Postal PCN was sent according to date of sending on letter 30 days after the 'incident' took place according to the same letter.
According to Paragraph 9 of POFA 2012 it should have been delivered within 14 days.

Does this mean I can contest jurisdiction?

Can someone point me in the direction of a claim defence I can use as a template?

I'm really confused at this moment so really appreciate any help or advice given, in just filling out the online form and gaining an extra 14 days, no idea whether I'm right in defending all of claim and whether i should be contesting the jurisdiction?

Thanks so much!

A vital part of your case will be lost if you can be identified by the PPC!

Your OP identifies the driver - you need to edit it so that who was driving is not identified in any way! (If you used your real name in your board name that also needs to be changed to preserve your anonymity). The ppcs do monitor this forum!

Then take time to read the newbies faq thread for advice on defending a court claim, where you will see your defence above needs going back to the drawing board!

(Just tick the form to acknowledge the claim (box 1) and send it back or send it online)
  • no idea how to change my user name? should i delete thread? :rotfl:

You can email and ask MSE to change it - tell them you have inadvertently used your real name. (forumteam@moneysavingexpert.com )

But edit the post to remove any references to who was driving (use expressions like "the driver parked.....")

No, that's not what it means. Thought you'd read the NEWBIES thread?
Can someone point me in the direction of a claim defence I can use as a template?
You appear to have stopped reading the NEWBIES thread at the very point where it was relevant! The section under 'Small Claim?' explains jurisdiction and how to complete the forms and gives you examples of defences.

Tell us when you have done the AoS. Don't ask what that is, read the right section in the NEWBIES thread!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
