Any help? Not paid my notice period - Xmas presents now looking unlikely for kids!

I was wondering if you could please advise me? I was released by a former employer on the 9th September. At that final meeting I was told that I was given 1 month's notice.


It is now the 22nd November and I have yet to be paid for the 1 month's notice or the work I did from the 1st to the 9th September.


The total amount outstanding is reasonably large. I have sent emails regarding this to the Accounts Department (who would usually have paid me) and a sterner letter to the CEO stating that I could now add charges. All to no avail.



I don't know what to do. The government website is pretty ambiguous.

    Well you go to court... Try MCOL if it's simply outdstanding money and no employment law issues.

    Try phoning them and chase it that way

    In order to go to court you would need to send a letter before action first. So do that.

    Are you sure you are entitled to the notice period? You say you were 'released' which sugests that you left without notice - did you have a mutual agreement for a shorter notice period? was anything confirmed in writing?

    Either way you are of course entitled to pay for the time you worked in Spetember and (depending on what was agreed) for the notive period.

    I would, asSangie says, send a formal letter before action then issue a legal claim. Make surethat you follo the instructions exactly, to do so.

    Although it's importnat to send the letter before action i would suggest also chasing by phone or in person - start with either HR or your direct line manager, and make a note of anything they say.

    I interpreted that as being sacked - the reference to a final meeting suggests a dismissal of some sort.
