Conflict of interest?

Hi, hopefully someone will be able to help me. 5 years ago, I was declared unfit for work and my organisation made me a leaving payment. This was all done via the company solicitor and everything was fine. 5 years on and I find myself in the middle of a TLATA battle with an ex friend over our jointly owned property. Thing is, the ex friend is using the same solicitor as my ex employer used. I have received a fully loaded, almost threatening letter from said solicitor that has caused me a lot of upset. What I'd like to know is, should this solicitor even be representing against me? Given we have previous history, could this be classed as a conflict of interest? Or am I being paranoid? Hopefully someone out there can help?

There is no conflict of interest here. Solicitors are permitted to act against the same person in two different cases.
There would only be a conflict of interest if, for example, the solicitor acted for you in one case and then against you in another case.
I hope you can manage to resolve the conflict with your friend. The strong advice is to try to resolve joint ownership disputes amicably as litigation would be very expensive.0 -
You're not being paranoid per se. It's not unusual to receive letters from solicitors in disputes that are 'fully loaded', as you put it. Correspondence like that is designed to put you under pressure. But as has rightly been said already, there is no conflict of interest and no reason that you have mentioned why this solicitor should not be representing the other party in this case.
Best of luck with resolving this. Litigation can be both expensive and a weight on you, so has again already been said amicable resolutions are generally preferable.
