Do we have any legal right to our grandad house?

Basically my grandad remarried over 20 years ago him and my step grandma bought a house together and both names where on the mortgages. The step grandma doesn't like any of my grandad relatives for no reason. She removed his name from the will and will give the house to her nephew who has never been to this country. Is my grandad children entitled to anything.and if not can we do anything. Thanks.

    Is he dead or alive?

    If he's died then you'd need to get a copy of his will (£10 or so) and read through to see what it says about "his half" of the house. If he left everything to his wife, then that's it.... and there's nothing for you.

    If his Will mentions anything about his grandchildren and trusts and things, then there's something there that she should've done to protect "his half" for you lot in the future after she's gone.

    If they own as joint tenants, basically it will belong fully to the surviving party, no exceptions.


    If they are tenants in common, each is able to leave to whom they wish

    Is it really any of your business who your granddad and his wife leave the house to? Why would you have any legal right to it?

    Do they own the property as 'joint tenants' or 'tenants in common'. See:

    You mean she removed his name from HER will? It is up to her who she leaves her property/estate to.

    What does grand dad's will say?

    If he wants to, your Grandad would need to separate the property to Tennants in Common so that he and your Step Grandma owned one half of the house each. He could then make a will that said that in the event of his death, your step Grandma could live in the house for the rest of her life and then when she dies the Grandchildren would receive his half. The problem of course would be whether your Grandad actually wanted to do this as it might upset the wife a bit.

    You don't have any rights to the house and if it is currently jointly owned, on the first death it would become the sole property of the surviving spouse. So if Grandad dies first it belongs to Grandma and she can do what she wants with it and vice versa.

    And BTW, the fact that the nephew has never been to the country really doesn't have anything to do with anything.

    In short, you have as many rights to the house as your grandad chooses to give you.
  • I already own more then 3 houses so I don't mind. But she made my grandad take his name of the house. He was paying the mortgages too. Also my grandad has 3 children and then loads of grandchildren so I won't see much even if I am entitled.

  • Ok sorry as much as I understand. The step grandma doesn't like us and the grandad very much as he didn't give her any kids so she its bitter towards him and his family. But they still married and live together. My grandad paid towards the mortgages when it was in both names. Then my step grandma didn't want to give anything to us and she made my grandad remove his name maybe under druess. . He has property overseas and has given us a power of attoney.
