When is it too late to take out home insurance re. A Legal claim

I'm a joint freeholder in a property with 2 leasehold flats. Currently have joint buildings insurance with the other freeholder but I have no contents.
The other freeholder and leaseholder of the other flat is currently carrying out some structural alterations to their flat. I am worried because they have not informed the buildings insurance about the works, which bare in any case specifically excluded from cover and am concerned by things I've seen that the builder is not doing it properly - using the proper support etc.

Would it now be too late to get a contents insurance policy with legal cover, in case we end up in a situation where legal action is needed to get the works done right?

From what you've said I don't think it would be too late.

New insurance policies will exclude anything which would bring about a claim before the policy started. If nothing has happened yet, then you should be good as you are only insuring for the possibility of something happening, which of course is the whole point of it.
