The hand book is wrong, continuity is not determined by written contract but by what you work.
If there is a gap of a week(including two Sat) between the written contract but you worked any time in that week(or used paid holiday) you get continuity of employment.
any contract without notice of an end date is effectively as permanent as any contact can be.
by working passed the old end date you on a contract with no end date.
How hard is it to understand if you are still on the rota or you turn up and were expected you have stayed on.
Not my fault they state wrong things then. That's another thing that goes against them then. Not knowing any different, why would I doubt what they say?
They can argue they just haven't got round to issuing a new contract. Can't see how I could make them tell me I was gonna be permanent just because they were taking their time with giving me a new contract. It has no end date at the moment just because they haven't told me about it yet.
I have never seen any rota in writing to be honest. Another reason why I didn't know if I was staying or not.
Anyway, all we have established so far is that Tesco don't know how contracts work.
I can tell you that I have the bloody right to know where I stand. Just because they didn't tell me clearly to not turn up that doesn't automatically mean I'm staying on (for all I know it could have been implied my employment automatically ended on the end date - that's how I intended it by the way) and it doesn't tell me how long they are gonna keep me for anyway.
I wouldn't know if I had to expect to be put on another temp contract or not. Anyway that I was being generically kept on I only found out by actually going in past my end date. I should have known before the end date.
Since they don't seem to be particularly quick to arrange stuff, they could have forgotten to inform me and I could have ended up turning up just to be told I wasn't expected as my contract had run out. It might be stupid for you but when I went in I had that worry and it would have been late night (I do night shifts) and I would have had trouble going home since I don't drive if I had gone in for nothing.
How is it that hard to understand I needed to have some reassurance and not all these implied stuff? I repeat it that we don't have a rota put up that we can all see.
I'm not even questioning what you told me. I am questioning the fact it's unreasonable to expect me to assume that a temp contract with a stated end date runs on automatically if they don't clearly tell you they are really wanting that contract to end on the end date stated. Can you see how it is stupid? Doesn't take them much to just open their mouth and say what's what, does it?0
