letter from eos

hi everyone, sorry in advance if ive posted this in wrong place but not really sure where to go
i am in debt to 7 creditors (dca) and have done my own dmp for lower payments.
since doing my own dmp i have come across the information on this forum re; cca and i still had one creditor (catalogue) to deal with so after receiving letter from dca i sent a recorded delivery letter to them asking for copy of cca, that was posted on wednesday morning, on thursday afternoon message left on answer phone asking me to phone them i did not. then this morning i received letter from them ( well, a with compliments slip) saying "please note that we are unable to provide a copy of agreement, therefore we have ceased action on this case."
what i would like to know is what happens now, does it go back to the original creditor or another dca.
also 3 of my other creditors are catalogue debts can i still ask them for a cca even though ive paid a couple of payments to them, as said before i did not realize i could ask for cca until after id sorted debt i know i have not signed any agreements with any of them.
any help would be great

Hi July, Looks like a good result with regards to to letter you have received
If they do not have a copy of the agreement it is unlikey that the original creditor would have a copy either as all it would take is a email and they would get the details you requested. Make sure you keep a copy of the letter safe incase they try to claim anything in the future. remember that after 6 years the debt becomes statute barred and they have no legal claim at all on any debts anyhow.
With regards to the other catalouge companies you have the right to request a a copy of the CCA and if they do not show it then you can stop paying I believe as tagain they have no legal claim. you could also then request a refund for the funds paid.

i was feeling very pleased with myself this morning after the posting from crown, but was disheartened to receive another letter demanding payment it was from moorcroft debt recovery
what do i do now?
the 1st dca (eos) could not produce a cca, so do i do the same to morecroft and ask them to for a cca, i know i didnt sign any aggreement with the creditor (freemans)
i would be grateful if someone could advise me again
also i only got letter on friday from eos saying they could not send copy of cca so how has moorcroft got hold of this debt.
please please someone help am getting worried now

Are moorcroft trying to get you to pay the same debt as the DCA you mentions in your first post?
Can you name the first DCA.
Moorcroft often buy debts that are out of date or otherwise unenforeable if the debtor knows their stuff.If you've have not made a mistake, you've made nothing0 -

yes its the same debt freemans catalogue and the other dca was "eos solutions", they could not produce cca

Must go but will ferret out the OFT Guidelines for Debt collection tomorrow, unless you can do a search for it and look for post by rog2?
Using multiple DCAs is not good practice.
You may have to do a CCA for them but the chances of them having it are slight.

have just read the oft guidelines but am a little unsure of what part refers to my case.

have sent a request for cca to moorcroft today via recorded delivery.
there letter says i have until saturday to reply.
gosh theres so much i want to ask but dont know how to put into words without it sounding like im thick.

I'm afraid I won't be any help to you with regards to specifics - but I can be a help in saying this...
If you want to know something - ask!
There are many people on here who can help - there are charities who can give you (totally free) advice (advice others will try to charge you for) and so on.
I get the impression most people feel pretty thick then they first turn looking for help - I know I certainly did.
You can't be helped unless you actually tell people what you need help with so...
Ask away!
Oh - and read any of the relevant stickied threads at the top of the Debt Free Wannabe forum too. There's some handy information to get you started - especially in the "for first time posters" thread.
