is a seller obliged to say so if the item they are selling is second hand?

I have been unable to find the answer to this question in this forum or elsewhere.
I have just bought an oven element from this company: http://www.essexappliancespares.co.uk/tricity-bendix-genuine-fan-oven-element-3117704001
It arrived without manufacturer's packaging and with some scratches. I have asked the supplier for the terms of the manufacturer's warranty.
I had assumed I was buying a new product but I am now wondering whether the element they sold me is second hand.
The supplier's website doesn't state whether the element is new or not. If the product as supplier is selling is second hand are they obliged to say so on their website?

Should have phoned them earlier. The element is new and it has a 6 month warranty.
They receive a number of elements at a time in a single box, hence the absence of manufacturer's packaging and the scratches.La luta continua!0
