section 38 agreement relating to the adoption of the estate roads.

Hi,
The section 38 agreement relating to the adoption of the estate roads has been requested by our buyers solicitors. Can anybody give me some advice on how I obtain this? The estate I live on was completed in Autumn 2015 and all the roads have had final surface and related road markings. However there is another developer who are further down the estate and they will be here for another few months. Should I contact the developer for this or the local council?

I would try your file for your purchase first, as you should have got it then. Failing that I would try the council, but don't you have a solicitor acting for you?0

I think you may be able to find this on the planning application for your development. Via your local councils planning portal0

Yes I do they have asked me to see if I have it but I have sent them everything from my purchase. I don't remember seeing it as part of my purchase documents and we were one of the first new build houses on the estate.0

I have the enquiries of local authority search which has a page full of section 38 entries with agreement and bond dates, is this what they require?0
