    I take it you mean that a person is not currently eligible for JSA but has belatedly realised that they may have been entitled to it at some point in the past ?

    My understnading is that it is possible to backdate a claim for JSA for up to three months but only if you can show good cause as to why a claim wasn't made at the time (examples would include if someone from DWP or CAB told you that you were not eligible)

    The grounds for it to be accepted would have to be extremely exceptional, if it's accepted at all.

    How long is the claim for? And how long ago?

    Being unaware of a benefit or eligibility for it is rarely if ever a case for back-dating,sorry.

    I may be missing something obvious, but how could you be unaware of the fact that you had less than £16k?

    • You would need a JSA1 form
    • You can only apply for the last 3 months from the date of your phonecall requesting a JSA1 to be sent to you
    • If you were to go to a jobcentre and ask for a JSA 1 to be given to you informally then it would be the previous 3 months from the date the form is recvd in the post by the DWP sorting office. Strictly speaking it should also be 3 months prior to the date you took the form from the Jobcentre but in practice this would not happen.
    • You would need a cast iron reason why you did not claim earlier.
    • Not knowing you could have claimed is not a valid reason
    • For JSA Conts there is no savings threshold, you should have claimed JSA IB (which includes Conts) anyway.

    Think there is a statutory limit to how far a claim could be backdated.

    If you had over 6k you would still get a tariff income deduction, so the amount would be vastly reduced.

    In the circumstances you describe, I would be very surprised if such a claim was successful, but that is just my opinion & I may be wrong!
