Capability for work questionaire

Hi, Wife has received one of these in the post today.


She gets DLA HRC LRM and was getting ESA (support group)
We stopped the claim a few weeks ago as we are over the 16K capital limit now.


Would stopping the claim have triggered this or is it likely to be random.
I'm surprised they sent it as she is/was in the support group.
Its a long form and will fill it out if needed but is it necessary?

    Contributions-based ESA is not dependent on capital limits and was payable without time limit in the support group.

    DLA is not dependent on capital limits at all.

    So you may want to check what your wife was actually claiming - whether income-based or contributions-based. ESA and DLA are separate benefits and not related.

    Her claim was income based hence the stoppage when our capital went over 16k.
    I'm asking if the form needs to be filled in or not.


    She still gets her DLA and I still get carers allowance.
    Everything else stopped, just as it should have.

    She will still be able to get her NI credits towards her state pension even if she gets no actual money and so for that could be worth completing

    If you stopped the claim fully as you seem to have done, as in you closed it down completely, you do not need to fill in the form.

    If you didn't close down the claim and 'signed off' completely you do need to fill it in if she wants her NI for pension paying.

    Not sure why you were surprised they sent it as being in the support group does in no way exempt her from reassessment in the future. I may have misunderstood you on this score.
