Maternity Pay with two jobs?

My wife had 2 jobs before she gave birth. One is 40 hours a week and qualifies for SMP. The other is just a few hours a week and therefore doesn't qualify for SMP. She would quite like to return to her 'small' job but we're unsure of the implications and whether it will affect her SMP from her main employer. She wants to return to her 2nd job as a few hours isn't as taxing as a 40 hour week and also it's in the evening so I can look after our little one.

Does anyone have any advice or experience? It's not as if she is starting a new job, which would feel a little underhand, she's had both jobs for at least 2 years.

    No it wont affect the SMP I know a few people who have done this, all above board
  • glentoran is spot on - regulation 8(1) of the SMP regulations allows you to return to work for the employer who was not liable to pay SMP without it affecting your right to SMP from the liable employer.

    To avoid a row or ill-feeling, I suggest your wife confirms this understanding with the SMP-paying employer so everyone knows where they stand.

    I read the OP as asking if the wife can return to the second job while still claiming SMP from the main employer. Forgive me if this is incorrect.
