Fake goods on ebay, what can i do

This is going to be a little long but please bare with me
In May this year i bought my gfriend some Sennheiser headphones and got quite jealous as i wanted some lol. The sound quality is much greater than any headphone ive had.
Today is my birthday
and got a pair myself, however they are fake. There are quite a few things wrong with them, and the sound is very very tinny, also parts are missing from the package.
If it was just one item the person had sold then i would probably leave it, but it looks like this seller is making a living from selling fake goods. The thing is if you have never used a Sennheiser pair of headphones you would not know the difference so i assume a lot of people are happy with their purchase. He / She sells other headphones and has over a 1000 feedback and only a few negative over a year, but if you look at the negative the buyer states how they are fake.
Now surely this cant happen, my gfriend has emailed saying she wants a refund, for postage aswell before she will return the item. The seller obviously knows they are fake, they are meant to come with different ear canal fittings for different size ears but they dont. She said if she doesnt recieve a refund in 5 days she will report them to ebay for fake goods. She also stated the things that were fake about them.
I dont think they should be able to get away with this
Any ideas what to do???

Firstly HAPPY BIRTHDAY! If the items he is selling are fake you should report him whether he gives you a refund or not. I would also write to Sennheiser giving them as much details as you can about the seller. I too have Sennheiser headphones and they are very good.0

I think, whatever the seller does, she should report him anyway. BUT, leave the neg until the refund is resolved.
I don't approve of this whole 'if you do what I'll say, I'll let you off' thing.
Reporting is anonymous anyway.
By the way I got a nice deal on Amazon for Sennheiser - in my local shop they were £100, got them on Amazon for £70.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

That is the review i used previously when i bought hers, she has decided to complain anyway, and ordered me some off a website that are a little more expensive but still
what will likely happen to the person, could they get done and how would Sennheiser react, dont want this person getting away with it as there are prob 100's of people who are paying for Sennheiser headphones and knowing no different as they are rubbish copies0 -

Ive found that ebays attitude towards fake/counterfeit goods is a joke.
Ebay put on a front that they dont allow the sale of such goods however the revenue gained from the sales of such items make it prudent to turn a blind eye to such items, after all ebay makes the same amount of commision from a genuine item as they do the counterfeit one, however this means that the consumer is the person who suffers, but even in this instance common sense must prevail, after all if, for instance, your buying a ralph lauren polo shirt off of ebay and its only £10 then you can pretty much put your house on it being dodgy.
Its about time that ebay took some responsibilty instead of just claiming to be a market place for sellers.
Concerning this issue, if yo uhave the persons address I would contact senheisser with the details, and also put a claim in with paypal.

I agree but unless people report the listings they will carry on selling them. I think the main problem is that 99% of the time buyers want counterfeit goods at low prices. You only need to go round large car boots/markets to see this.
If buyers want the genuine article they must pay more and do a bit of research. The find the genuine sennheiser headphones I just put genuine in the search box and the majority of the listings were just that.0 -

Some manufacturers don't seem to care about fakes/copies, a classic example are Crocs.0
