Child Bennefit Question

Hi

I wonder if anyone can share some advice please.

I live with my partner who has a daughter - we have lived together for 8 year. She is not down as my dependant and has a dad she lives with half of the time.

We just had another daughter together but were told we werent entitled to child tax bennefit for my new daughter as I earn to much ( I earn 60k) my partner is on maternity leave and gets statutory.

My Partner claims tax bennefit for her daughter.

I opened a letter today from HMRC that says my tax code will change to the tune of £700 per year worse off becuase my parter claims child bennefit.

Can i ask why my tax code will change for a a child thats not mine when I cant claim for the one that is mine.

Is her dad paying as well?

why has this suddenly changed?

Im so confused?

    Can you just confirm that your partner is claiming child tax credits and child benefit for her daughter from her previous relationship?

    So your partner is claiming child benefit for her daughter from a previous relationship and that daughter lives with you for half the time

    You may have to pay a tax charge, known as the ‘High Income Child Benefit Charge’, if you have an individual income over £50,000 and either:

    you or your partner get Child Benefit
    someone else gets Child Benefit for a child living with you and they contribute at least an equal amount towards the child’s upkeep

    It doesn’t matter if the child living with you is not your own child.

  • What is the tx benefit that you refer to, OP? Do you mean child benefit or does your partner receive child tax credits as well?
  • If the Dad she lives with half the time earns less than £50k he could claim it instead. Then your tax wouldn't be affected.

    As a household you are not entitled to claim any child benefit. As your parner does claim then your tax code is restricted to claw back the money.

    The child's father will not be receiving child benefit so it has no relevance to him.

    If your partner stops claiming child benefit then your tax will not be affected but of course your partner will lose the child benefit payment.

    as said above , If she stops claiming the child's father could claim it instead if he earns less then £50.000

    why has this suddenly changed?

    I expect that your claim for your own child is the first time that child benefit have been aware that you have a partner claiming the benefit and your income is over the limit.
