Parking ticket help pls

Lets begin with im a not the smartest person and get lost in the legal stuff.
So my dad got a fixed charge notice the other day though the post with 2 pics one of a ticket with the date and expiry time and one of the front of the car. We rushed back to the car and no notice was on the car, they had only sent it though the post.
I know we can appeal even though we have no grounds to if that make sense.

from the MSE PAGE mse.com reclaim private parking tickets
The technical route: check if your 'Notice to Keeper' is flawed

How do I do this please as there are no lists that I can find only a link to this fourm.

I have downloaded the appeal letter but have no idea where to start, the main thing im looking at is to get the amount down
[If appealing to a BPA member]The charge is disproportionate and not commercially justifiable

The amount you have charged is not based upon any commercially justifiable loss to your company or the landowner.

According to the Unfair Consumer Contract Regulations, parking charges on private land must not exceed the cost to the landowner during the period the motorist is parked there. In my case, the [insert figure] charge you are asking for far exceeds the cost to the landowner of [insert details of the parking costs eg if the fee is £50 but parking costs £1-an-hour you’d need to have been there for 50 hours to justify the charge].

How can I do this please ?

If this makes any sense at all.

So sum it up want to try and do the I feel the fine is unfair cause the lose to the company was not £45
and its a letter to the registered keeper.
Im also thinking how can a little time stamp on a photo be proof. also how can a separate pic of a car and ticket be proof

You need to start by getting stuck into the Newbies Sticky at the top of this forum.

It contains the most current info and advice on how to challenge these tickets and you need to couch your appeal in those terms, not what actually happened - PPCs don't usually consider realities.

Also, which firm was it - there are different approaches for some of them.

Was this a council car park or a private car park (supermarket, retail outlet with lots of shops, cinema etcetera?)

If council, go to pepipoo.com, read the FAQs then post your query there.

If it was a private car park, we need to know the name of the parking company (precise details please as there are several with similar names or initials.)
We will also need to know the date of the parking event, and the date you received the notice to keeper/owner (the letter that arrived in the post.)
Then read the Sticky thread for NEWBIES especially the template appeal letter that you will need to send off exactly as it is. Don't change a thing.
If possible, scan and post redacted copies of the notice to keeper and the tickets if you still have them. Upload them to a web hosting site such as tinypic or photobucket then post the URL here but change http to hxxp as newbies can't post links or pics. Don't worry too much about this now, the important thing is to get the appeal template sent off before the appeal deadline.
This assumes the car was in a private car park in England or Wales and the car isn't a hire or lease vehicle.

it was a private car park, napier parking
13/10/15 and letter sent on the 15/10/15 we received it on the 17/10/15
this also happened about 100 miles away from me so its not just a quick trip back to take picture of signage.
  • So reading the noob thread

If no time to 'dig out flaws' in paperwork, just use our appeal example unless your PCN was from these where you will certainly need to start a new thread:

'Devere' (Bournemouth usually, e.g. at Castlepoint)
    'District Enforcement'
    (Staffordshire University etc.)
    'Secure -a-Space'
    'Napier'
    'Combined Parking Solutions'

although you can appeal it and also you could try a popla appeal, the chances of winning are not good so you will have to decide if its worth the hassle or if you should pay up

Napier do read this forum and are better than most at pursuing these matters
