Have I Got A Good Argument ?

I sent off to Halifax to request my statments in May, the 40 day deadline was 4th July. I received a letter acknowledging my request and my £10 cheque was returned explaining they no longer charge £10. The letter explained the normal 'we've received loads of requests but will deal with yours as soon as possible'.
I phoned the customer care line on 11th July as I had still not received my statments and the lady explained there was no record of my request on the system and she would e-mail the team involved to request them.
I phoned again on the 1st August as I had still not received them, I spoke to Tom who apologised and said he would send an e-mail to the team and mark it 'urgent'.
I finally received my statements on 10th August - 27 working days late.
I worked out my claim and sent the letter requesting the money, I have now received a letter explaining because of the legal proceedings my claim will now be on hold until after the case.
My argument is though, if I had been sent the statements within the dates I should have had them, my claim would have been made before the case had started. I think I was pretty patient waiting for my statements and I could have reported them for failing to send them, but I didn't.
It makes me even more mad that i sent off for my parents statement on the same day sand their process is complete with their claim paid into their bank in July.
Do you think I have a good case to argue or will I just have to wait as said in the letter?
