Shared parental leave

I am planning on returning to work after 7.5 months on maternity.

Can my DH then take 1 month of parental leave using up what I would have received on SMP? e.g. Swapping his salary for £140 ish a month.

Can his work refuse?

Would his parental leave have to start the week immediately after I went back to work? Or could it start one week later?

As we are not planning on having any more kids, it would be the only opportunity my DH would ever have to do such a thing, hence we thought we would look into how feasible it is.

    Use the .gov website to work out if you are both eligible (depends on a number of factors) but as far as I'm aware his work can't refuse and you share the smp, holiday accruement rights etc.

    I was also going to recommend the gov.uk site as a starting point, but Rambosmum was quicker on the draw!
