Carer's Allowance And Contribution based JSA

From 2010 to 2015 I was my fathers full time carer and I received carers allowance and I was credited with class 1 national insurance stamps for this time

I have just tried to get Contribution based JSA and been refused

because I have not paid or been credited with enough class 1
insurance contributions

And they have used the tax years ending April 2009 and 2010
for their calculations

the two years before i claimed carers allowance


surly they should have used the years 2013 - 2014

the two years before this tax year

for the purpose of class 1 insurance contributions for

contribution based JSA

    I agree they should have been using tax years 2012-13 and 2013-14. however, I have a feeling that for contributions based JSA, it;s not enough to have class 1 NI credits awarded via a benefit, you have to have actually been in an employment.

    There's been a thread recently from a poster in a similar situation (I think called r_i_c ?) but I can't find it at the moment - perhaps someone else can locate it ?
  • I don't think NI credits from your carers would be enough for JSA contributions, only to keep your record up to date for your pension.

    I don't know why they have used those 2 years but the two previous tax years ended in 2014 and 2015, not 2013. The amount you had to be earning for 50 weeks of the year was £109 and £111 a week, carers is only around £60, yes?

    DWP haven't started using tax year 2014-15 yet though. They move the tax years they use when looking at qualification for contribution based benefits forward at the start of each calendar year - so from the beginning of this year they've been using 2012-13 and 2013-2014. In January they will start using 2013-14 and 2014-15.

    I think this is to allow for the fact that there's potentially a time lag between the end of the tax year and when a persons NI records for the year are updated and available....

    found it ! It's not quite the same situation as this one, r_i_c was looking to claim ESA(c) but I think the reason he was refused will also apply to JSA(c) - Post #21 is the most relevant

    Class 1 credits have to be accompanied by Employed class 1 contributions in at least one of the tax years.

    NI credits alone will not entitle you to Contributions Based benefits. That's why the years before you claimed CA have been looked at. It seems that you don't have sufficient NI contributions in those years either which is why you can't get Contribution based JSA.
